1st Degree Criminal Sexual Conduct and Burglary Charges Dismissed

The Anderson Law Firm recently was successful in having charges of 1st Degree Criminal Sexual Conduct and 1st Degree Burglary dismissed in Meeker County District Court.

In this case, our client was accused of forcing his way into a home and sexually assaulting another individual therein. Despite the lack of any physical evidence and no corroboration of the allegations by law enforcement, prosecutors still went forward with charges based solely on the allegations of the complainant.

After months of independent investigation, the Anderson Law Firm was able to discover evidence that showed our client was not within 100 miles of Meeker County during the time that the reported offenses were alleged to have occurred. Despite providing this information to prosecutors, they refused to dismiss the charges and insisted on a very high bail amount so that our client could not obtain his release from custody.

Thus, the Anderson Law Firm filed a contested probable cause motion (also known as a Florence hearing), requesting that the charges be dismissed for lack of probable cause. Since the State was not able to offer any evidence that contradicted our client’s location history during the time of the alleged offense, the district court dismissed the charges.
