On February 20, 2013, Kirk Anderson argued before the Minnesota Court of Appeals in the case of RKL Landholding, LLC v. Kevin James. The issue in the case is whether the district court erred in granting the Respondent’s motion for summary judgment prior to a jury trial. Mr. Anderson argued that the district court made determinations of fact, which is inappropriate on a summary judgment motion.
The Court has 90 days to issue a decision.
