In November 2012, the Minnesota Supreme Court granted review of the issue of whether the motor vehicle exemption is applicable to civil forfeiture. The Minnesota Court of Appeals determined that the exemption was not applicable to civil forfeitures. Nielsen v. 2003 Honda Accord.
The case has now been fully briefed and we are awaiting scheduling of the oral argument before the Minnesota Supreme Court. It is anticipated that the case will be heard sometime this Spring, with a decision in the Fall.
